Terms, Conditions & Cancellation Policies | Mike’s Fishing & Tours

1. Reservation & Payment Terms

Booking Confirmation: A reservation is officially confirmed upon receipt of the required deposit (typically 50% of the total quote) or full payment.
Remaining Balance: The outstanding balance must be paid in full prior to boarding the vessel on the date of the service.
Accepted Payment Methods: We accept Visa, Mastercard, bank transfers, and cash. American Express (AMEX) is NOT accepted. Online platform transactions may incur applicable processing fees or taxes.
Port & Terminal Fees: A mandatory port authority entry fee is not included in the charter price. This fee is regulated by port authorities, must be paid in cash at the dock upon entry, and is subject to change without prior notice.
Protected Marine Area Fees (Marietas Islands): Excursions to protected national parks require a mandatory conservation bracelet fee of $250 MXN per person. Optional access to swim into Hidden Beach (Playa Escondida) incurs an additional $700 MXN per person. Both fees must be paid in cash directly upon boarding.

2. Public Tours Policy

Cancellation More Than 48 Hours Prior: 100% full refund.
Cancellation Within 24 to 48 Hours: Non-refundable, but eligible for rescheduling to a future date (subject to boat availability).
Cancellation Within 24 Hours or No-Show: 100% cancellation fee; no refund or reschedule will be provided.
Boarding & Grace Period: Public tours depart strictly on schedule. A 15-minute grace period is permitted. Late arrivals beyond this window forfeit their ticket without refund.

3. Private Charters Policy (Boats, Yachts & Catamarans)

Cancellation More Than 7 Natural Days Prior: 100% refund of the deposit or amount paid.
Cancellation Between 4 to 6 Natural Days Prior: 50% refund of the deposit or amount paid.
Modification Within 72 Hours (3 Days) Prior: You may reschedule your tour to another date (subject to boat availability). No cash refunds will be issued.
Modification Within 48 Hours (2 Days) Prior: You may request a time adjustment on the same date (subject to operational feasibility). Date changes are not permitted within this window, and no refunds will be issued.
Rescheduled Charters: Once a private charter date has been modified or rescheduled, it becomes strictly non-refundable under any future cancellation request.
No-Show & Late Arrival: A 30-minute grace period from the agreed departure time is permitted. After 30 minutes, the vessel will set sail or the charter will be canceled with zero refund.
Promotional Rates & Special Offers: Bookings completed under promotional codes or seasonal discounts are strictly non-refundable and non-transferable.

4. Guest Capacities, Extra Passengers & Relocation Fees

Base Passenger Quotas: Charters are priced based on the vessel’s base passenger capacity specified in your confirmation.
Additional Passengers: Extra guests beyond the base agreement (up to the maximum certified capacity of the boat) incur an additional charge.
Unused Passenger Spots: Reductions in group size must be notified at least 48 hours in advance. Unused passenger spots canceled within 48 hours will be charged at the full agreed rate.
Vessel Relocation Fees: Custom departures or drop-offs at La Cruz de Huanacaxtle or Punta de Mita incur a net relocation fee of $200 USD (Boats/Yachts) to $250 USD (Catamarans).

5. Operations, Safety & Weather Policies

Weather Cancellations: The Captain of Mike’s Fishing & Tours holds exclusive authority to assess sea and weather conditions. If a trip is canceled due to unsafe weather or port closures, guests will be offered a rescheduled date or a 100% refund.
Captain’s Authority & Onboard Conduct: The Captain has complete authority over navigation and safety. The possession of illegal substances, weapons, or aggressive/unsafe behavior will result in immediate termination of the service without refund.
Early Return Due to Guest Illness: If a passenger becomes ill or requests an early return to port, the charter concludes immediately, and no refund will be issued for unused hours.
Live Bait Availability: Live bait for fishing charters is subject to seasonal availability. If live bait is unavailable, alternative lures/methods will be used, and no refunds or discounts will apply.

6. Liability, Belongings & Intellectual Property

Assumption of Risk: Guests acknowledge that nautical activities involve inherent risks. By boarding, passengers voluntarily assume all risks associated with the excursion. Mandatory safety gear (life jackets) must be worn when instructed by the crew.
Personal Belongings: Mike’s Fishing & Tours is not responsible for lost, damaged, or stolen personal belongings, electronics, or valuables brought aboard.
Intellectual Property: All content, logos, photography, and text on this website are the property of Mike’s Fishing & Tours and protected under copyright laws.
